Darkhorse Powersports LLC ("Darkhorse Powersports," "we," "us" or "our") operates a powersports dealership located at 712 Southwest Blvd, Clinton, NC 28328. This Privacy Policy explains what information we collect through our website, our forms, our phone and text lines, and our in-store operations, and how we use and protect it.
By using our website or submitting information to us, you agree to the practices described in this policy.
2. Information we collect
We collect information you give us directly, including:
- Contact information — name, mobile or landline phone number, email address, and mailing or physical address.
- Inquiry details — the vehicle, part, service or financing you ask about, along with any message you send us.
- Transaction information — purchase, trade-in, service and warranty records.
- Financing information — where you apply for financing, information required by our lending partners. This is collected under a separate application and is governed by that application's disclosures.
- Communications — records of calls, text messages and emails between you and us.
We also collect limited technical information automatically when you visit our website, such as IP address, browser type, device type, pages viewed, and referring page.
3. How we use your information
- To respond to your questions, quotes and service requests
- To send transactional messages such as appointment reminders, service status updates, parts arrival notices and financing follow-ups
- To send promotional messages about inventory, events and offers, where you have opted in
- To process sales, trade-ins, service work and warranty claims
- To operate, maintain and improve our website and our business
- To comply with legal, tax, safety-recall and recordkeeping obligations
4. SMS text messaging and mobile information
If you provide your mobile number and opt in (for example, by checking the text message consent box on our home page sign-up form or contact form), Darkhorse Powersports may send you recurring SMS text messages relating to your inquiry, inventory availability, your vehicle, your service work, appointment reminders, and promotional offers. Opting in is optional; you can submit our forms without it.
No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service and the providers that deliver our text messages, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging service itself.
Additional terms that apply to our text messaging program:
- Consent to receive text messages is not a condition of any purchase.
- Message frequency varies based on your activity with us.
- Message and data rates may apply, depending on your mobile carrier plan.
- You may opt out at any time by replying STOP to any message. You will receive a single confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again.
- Reply HELP to any message, call us at (910) 249-4700, or email us for assistance.
- Carriers are not liable for delayed or undelivered messages.

5. How we share information
We do not sell your personal information. We share information only as needed to run our business, including with:
- Service providers that operate on our behalf — website hosting, dealership management software, email and text message delivery, and analytics. These providers may only use the information to perform services for us.
- Lenders and financial institutions, where you have asked us to submit a credit or financing application.
- Manufacturers and distributors, for warranty registration, recall notices and rebate processing.
- Legal and safety recipients, where required by law, subpoena, or to protect our rights, property or the safety of others.
- A successor entity, in connection with a merger, acquisition or sale of assets.
All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging service itself (see Section 4).
6. Cookies and analytics
Our website may use cookies and similar technologies to remember your preferences, understand how the site is used, and measure the performance of our advertising. You can control cookies through your browser settings. Disabling cookies may affect how parts of the site function.
We use Google Analytics to understand how visitors use our website, such as which pages are viewed and which buttons are clicked. We keep personal information for as long as needed to fulfill the purposes described in this policy and to meet legal, tax and warranty recordkeeping requirements. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

- Text messages — reply STOP to opt out at any time.
- Email — use the unsubscribe link in any marketing email.
- Phone calls — tell us and we will add you to our internal do-not-call list.
- Access, correction and deletion — contact us at email us to request a copy of the information we hold about you, to correct it, or to ask us to delete it, subject to records we are legally required to keep.
9. Children's privacy
Our website and services are intended for adults. We do not knowingly collect personal information from anyone under 13 years of age. If you believe a child has provided us information, contact us and we will delete it.
