1. Acceptance of these terms

These Terms & Conditions govern your use of the Darkhorse Powersports website and your participation in our text messaging program. By using this site, submitting a form, or opting in to receive text messages, you agree to these terms. If you do not agree, please do not use the site or opt in.

Program description

Darkhorse Powersports operates a text messaging program that sends customer care and informational messages, including responses to inquiries, inventory and availability updates, service and repair status, appointment reminders, parts arrival notices, financing follow-ups, and promotional offers such as sales, events and new inventory.

How to opt in

You may opt in by entering your mobile number and checking the optional, unchecked-by-default text message consent box on our contact form or our home page sign-up form, or by giving us written consent in the store. Checking the box is not required to submit either form. You must be 18 or older, or have the permission of the mobile account holder, to opt in.

Message frequency

Message frequency varies and depends on your interactions with us. Most messages relate to your inquiry, a purchase, a service order or an appointment; promotional messages are occasional.

Cost

Msg & data rates may apply. These charges come from your mobile carrier and are your responsibility. Contact your carrier for details of your plan. Darkhorse Powersports does not charge for text messages.

Opting out

You can cancel the SMS service at any time by replying STOP to any message from us. After you send STOP, we will send a single confirmation message and will not send any further messages unless you opt in again. You may also call (910) 249-4700 or email email us to be removed.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your wireless service provider and is outside our control. Supported carriers may change without notice.

Mobile information collected through this program is handled as described in our Privacy Policy. No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes.

3. Inventory, pricing and availability

We work to keep inventory, pricing and specifications accurate, but errors occur and units sell quickly. All listings are subject to prior sale. Prices shown exclude tax, tag, title, registration, freight, setup, destination and dealer documentation fees unless expressly stated. Manufacturer images, colors and specifications may differ from the actual unit. Nothing on this website is an offer to sell; a sale is formed only by a signed purchase agreement. We reserve the right to correct any error at any time.

4. Financing

Any monthly payment shown on this site is an estimate for illustration only. Estimates assume a representative down payment, term and annual percentage rate, and do not include tax, title, fees or insurance. They are not an offer or commitment to lend. Actual terms depend on lender approval, your credit history and the unit purchased. All financing is subject to credit approval by a third-party lender.

5. Service, parts and warranty

Service estimates are approximations and may change once work begins; we will contact you for authorization before exceeding an approved estimate. Vehicles left more than 30 days after service completion may be subject to storage charges as permitted by North Carolina law. Manufacturer warranties are provided by the manufacturer, not by Darkhorse Powersports, and are subject to the manufacturer's terms. Used units are sold as-is unless a written warranty is provided.

6. Website use and intellectual property

All content on this site, including text, graphics, logos and layout, is owned by Darkhorse Powersports or its licensors and is protected by applicable law. Manufacturer names, logos and model names are the property of their respective owners and are used for identification only. You may not copy, scrape, republish or use our content for commercial purposes without written permission. You agree not to use the site unlawfully, to submit false information, or to interfere with the operation of the site.

7. Third-party links

Our site may link to third-party websites, including manufacturers and lenders. We do not control and are not responsible for the content, products or privacy practices of those sites.

8. Disclaimer of warranties
